  • "Traveler": The individual travelling or making a booking for travel.

  • "Service Provider": Hotels, airlines, shipping, rail, and other third-party service providers contracted to serve the Traveler.

  • "Package": Refers to land-only packages, excluding flights.

  • "Cost Per Person": Total per-person cost as detailed in the booking quotation.

  • "Infant/Child": Infant is under 2 years old; child is between 2 and 11 years.

  • "Payment, Deposit and Cancellation Policy": Refers to the deposit terms outlined at time of booking.

2. Website Use & User Obligations

By using the website, you warrant that:

  • All information provided is accurate and up to date.

  • You are over 13 years old.

  • You will not engage in unlawful, abusive, or fraudulent activities.

  • You may be denied access at any time without notice for violations.

You agree not to:

  • Use the website for unauthorized or commercial purposes.

  • Bookings may be cancelled if any provided information is incorrect or suspected to be fraudulent.

  • No liability is assumed for cancellations caused by misrepresentation or unauthorized activity.

5. Indemnification

Travelers agree to indemnify and hold harmless the Companies and affiliates for losses resulting from:

  • Breach of these Terms.

  • Misrepresentation or violation of laws or third-party rights.

6. Human Error

Errors made during booking due to human error will be rectified if reported within 4 hours. Liability is limited to the service fee collected.

7. Traveler’s Responsibility

  • Travelers must verify service descriptions before booking.

  • Group booking leaders must ensure all parties understand these terms.

  • Compliance with all applicable local and international regulations is required.

  • Travelers consent to communication via phone, SMS, and email, including overrides of NCPR.

8. Privacy Policy

Use of the website is subject to the Privacy Policy. Personal information may be disclosed:

  • To protect company systems.

  • In response to legal requests.

  • As necessary to operate the business.

9. Prohibited Activities

Prohibited use includes but is not limited to:

  • Illegal content.

  • Intellectual property infringement.

  • Impersonation or fraudulent identity.

  • Spamming or disruptive conduct.

  • Hacking, unauthorized access, or malware distribution.

10. User Accounts

  • You must safeguard your account credentials.

  • You may not impersonate others or create multiple accounts.

11. Content Contributions

  • Users grant TycoonDMC a non-exclusive, perpetual license to use contributed content.

  • Content must not be unlawful, infringing, abusive, or misleading.

  • TycoonDMC may display ads next to user content without compensation.

12. Products & Bookings

  • All bookings are subject to availability and service provider terms.

  • Travelers must be at least 18 years of age.

  • Fraudulent bookings are grounds for termination.

13. Modifications & Amendments

  • A fee (approx. 20% or USD 20) applies for date changes requested 3+ days in advance.

  • Special event tickets are non-changeable.

  • Late changes may incur additional fees and are not guaranteed.

14. Pricing & Inclusions

  • Prices are per person unless stated otherwise.

  • Pricing excludes taxes, gratuities, visas, insurance, and personal expenses.

  • Prices may change post-booking due to currency fluctuations or availability.

15. Payments & Cancellations

  • Full payment is required via credit/debit card in THB.

  • No refunds after service commencement.

  • Cancellation Policy (unless otherwise stated):

    • 50% refund if cancelled 25+ days before experience.

    • No refund within 25 days.

  • All payments are subject to bank fees and currency conversion.

16. Private Tour Guides

  • Private guides are independent contractors. Use is at Traveler’s own risk.

  • The Companies make no warranty regarding their services.

17. Member-Only Deals

  • All sales final; 100% cancellation fee applies.

  • Only available to registered users.

18. Vouchers & Tickets

  • You must present the original voucher and valid photo ID.

  • The company may require the same credit card used at booking.

  • Fraudulent use will result in voucher cancellation.

19. Gift Certificates

  • Non-refundable and not redeemable for cash.

  • Valid for 2 years unless prohibited by law.

  • Unused balances are retained for future use.

20. Passports, Visas & Insurance

  • It is the Traveler’s responsibility to ensure valid documents and vaccinations.

  • The Companies are not liable for entry refusals or denied boarding.

  • Travel insurance is strongly recommended.

21. Liability Disclaimers

  • Services and content are provided "as is" without warranties.

  • TycoonDMC is not responsible for third-party errors, changes, or disruptions.

  • No liability for indirect or consequential damages.

22. Your Liability

You are liable for:

  • Breach of contract or law.

  • Infringement of third-party rights.

  • Misuse of the website or services.

23. Third-Party Links

  • External websites are not under TycoonDMC’s control.

  • No liability is assumed for external content or practices.

2. การใช้งานเว็บไซต์และหน้าที่ของผู้ใช้

6. ข้อผิดพลาดจากมนุษย์

หากเกิดข้อผิดพลาดในการจองและแจ้งภายใน 4 ชั่วโมง บริษัทจะดำเนินการแก้ไข โดยความรับผิดจำกัดเฉพาะค่าบริการที่บริษัทเรียกเก็บ

7. ความรับผิดชอบของนักท่องเที่ยว

  • นักท่องเที่ยวต้องตรวจสอบรายละเอียดบริการก่อนการจอง

  • ผู้จองกลุ่มต้องแจ้งข้อกำหนดให้สมาชิกทุกคนทราบ

  • ต้องปฏิบัติตามกฎหมายที่เกี่ยวข้อง และยินยอมให้ติดต่อผ่านโทรศัพท์ อีเมล หรือข้อความ

8. นโยบายความเป็นส่วนตัว

ข้อมูลส่วนบุคคลอาจถูกเปิดเผยในกรณี:

  • เพื่อปกป้องระบบของบริษัท

  • ตามคำขอของหน่วยงานราชการหรือคำสั่งศาล

  • เพื่อการดำเนินธุรกิจตามกฎหมาย

9. กิจกรรมต้องห้าม

  • ผู้ใช้งานให้สิทธิ์แก่บริษัทในการใช้ แก้ไข แปล เผยแพร่เนื้อหาของตน

  • ห้ามส่งเนื้อหาที่ผิดกฎหมาย ละเมิด ล่วงละเมิด หรือทำให้เข้าใจผิด

12. การจองและผลิตภัณฑ์

  • ขึ้นอยู่กับความพร้อมของบริการ

  • นักท่องเที่ยวต้องมีอายุอย่างน้อย 18 ปี

  • การจองที่เป็นการฉ้อโกงจะถูกยกเลิกทันที

13. การเปลี่ยนแปลงหรือแก้ไข

  • คิดค่าธรรมเนียม 20% หรือ 20 USD หากแจ้งล่วงหน้าเกิน 3 วัน

  • ตั๋วกิจกรรมพิเศษไม่สามารถเปลี่ยนแปลงได้

  • การเปลี่ยนแปลงในช่วงใกล้วันเดินทางอาจมีค่าธรรมเนียมเพิ่มเติม

14. ราคาและสิ่งที่รวม/ไม่รวม

  • ราคาต่อคน ยกเว้นระบุเป็นอย่างอื่น

  • ไม่รวมภาษี ทิป วีซ่า ประกัน หรือค่าใช้จ่ายส่วนตัว

  • ราคาสามารถเปลี่ยนแปลงได้หลังการจองหากมีความผันผวนของค่าเงินหรือความพร้อมของบริการ

15. การชำระเงินและการยกเลิก

  • ต้องชำระเต็มจำนวนด้วยบัตรเครดิต/เดบิตในสกุลเงินบาท (THB)

  • ไม่สามารถคืนเงินหลังเริ่มใช้บริการ

  • การยกเลิก:

    • คืนเงิน 50% หากแจ้งยกเลิกล่วงหน้าอย่างน้อย 25 วัน

    • ไม่คืนเงินหากยกเลิกภายใน 25 วัน

16. มัคคุเทศก์ส่วนตัว

  • มัคคุเทศก์เป็นผู้รับจ้างอิสระ บริษัทไม่รับผิดใด ๆ ต่อบริการที่พวกเขาให้

17. ข้อเสนอพิเศษสำหรับสมาชิก

  • ไม่สามารถคืนเงินได้

  • ใช้ได้เฉพาะสมาชิกที่ลงทะเบียนเท่านั้น
